Revised MRP Declaration on Unsold Pre-Packaged Commodities Due to Change in GST Rates

The Department of Consumer Affairs (Legal Metrology Division) issued a major update on 9 September 2025. Food Manufacturers, Food packers, and Food importers of pre-packaged goods can now revise the Maximum Retail Price (MRP) on unsold stock after any change in GST rates.

This permission, granted under Rule 33 of the Legal Metrology (Packaged Commodities) Rules, 2011, helps the industry adjust to new tax rates without wasting packaging materials ensuring both compliance and sustainability.

Key Highlights

1. Permission for Revised MRP Declaration
Businesses can now declare the new MRP on unsold stock through stamping, stickers, or online printing. This provision stays valid until 31 December 2025, or until the old stock is sold, whichever comes first.

2. Display of Original and Revised MRP
Both prices must be visible. The new MRP cannot cover or overwrite the old one.

3. Limit on Price Revision
The price increase must only reflect the change in GST or related tax components. No additional markup is allowed.

4. Public Communication
Companies must publish at least two newspaper advertisements and notify dealers. They must also inform the Director of Legal Metrology at both Central and State levels.

5. Use of Old Packaging Materials
Manufacturers may continue using pre-printed packaging until 31 December 2025, provided revisions are made only to update GST-related changes.

This decision offers temporary relief to FMCG and food manufacturers by reducing packaging waste and ensuring smooth compliance. It also promotes price transparency, as consumers can see both the original and revised MRPs.
