The Food Safety and Standards Authority of India (FSSAI) expired license closure report has introduced a critical compliance update for all food business operators (FBOs): it is now mandatory to submit a closure report upon the expiry of their FSSAI license or registration. It is also cautioned that the FBO does not operate a food business with an expired food license. The Food Business Operators (FBO) are mandated to update the reason for the expiration of the food license.
This new requirement was passed by the FSSAI, effective from 16th May 2025, The aims to enhance regulatory transparency and maintain accurate records within the FoSCoS (Food Safety Compliance System) portal. All FBO licenses which expired in the financial year 2024-2025 are mandated to submit the expired license closure report for their FSSAI license/registration. This procedure is crucial to manage the misuse of the expired license and aims to keep track of the operational food business.
Closure Report filing
Previously, many expired licenses remained unaccounted for in the system, leading to discrepancies and inactive FBOs still appearing in compliance records. To resolve this, FBOs whose licenses or registrations have expired must now log into the FoSCoS portal and submit an expired license closure report through the โProceduresโ tab under โFile your response.โ
Three response options are available:
- Reference number of renewal already applied
- Details of the old license if a new one has been issued
- Declaration of business closure
This move allows FSSAI to ensure only active and compliant food businesses are reflected in its database and helps reduce risk during audits, traceability investigations, and enforcement actions.
Penalties for Not Having a Valid FSSAI License
The food business operating without the FSSAI license or Expired license are treated as violating the section 31 of food safety and standards act of 2016. This also leads to a penalty of up to 10 lakhs under section 63. This legal framework mandates all food businesses in India who are into selling food products must operate with a FSSAI food license.
