FSSAI Packaging Amendment Regulations 2026: New Definitions for Packaging

The FSSAI Packaging Amendment Regulations 2026 introduce important updates to the Food Safety and Standards Packaging Regulations, 2018. FSSAI issued the draft notification on 26 February 2026 to clarify regulatory terminology used in food packaging.

In particular, the amendment introduces new definitions related to food contact materials and modern packaging technologies. Clear terminology helps regulators interpret packaging requirements consistently.

Moreover, the food industry increasingly uses advanced packaging systems. For example, modified atmosphere packaging and aseptic packaging now play a major role in extending shelf life and protecting food quality.

Therefore, FSSAI released the draft amendment for public consultation. Stakeholders may submit objections or suggestions within sixty days from the date of publication.

Purpose of the FSSAI Packaging Amendment Regulations 2026

Packaging plays a critical role in the food supply chain. It protects food from contamination and preserves product quality during storage and transportation.

At the same time, packaging technology continues to evolve rapidly. Modern systems such as modified atmosphere packaging and aseptic packaging now appear across many food categories.

Consequently, regulators must define these technologies clearly. The FSSAI Packaging Amendment Regulations 2026 address this need by introducing new definitions within the packaging regulations.

As a result, clearer terminology will support consistent regulatory interpretation and help food businesses choose compliant packaging materials.

Definitions Introduced Under the Draft Amendment

The draft amendment introduces several definitions in Regulation 2 of the Food Safety and Standards Packaging Regulations, 2018. These definitions clarify important concepts related to food contact materials and packaging technologies.

Food Contact Material

“Food contact material’’ means any material, including active and intelligent materials, article and product intended to come into contact with food and should not have any undesirable effect on the food and health.

Food Grade Contact Material

“Food grade contact material’’ means any material(s) that are used for manufacturing, processing, handling including kitchenware, tableware, packaging, storage and transportation of food contact material should have demonstrated their compliance with specific safety standards under prescribed conditions and shall not endanger human and animal health and result in an unacceptable change in the composition and characteristics of food during its intended use.

Modified Atmosphere Packaging

“Modified atmosphere packaging’’ (MAP) means enclosure of food in a package in which the atmosphere inside the package is modified or altered to provide an optimum atmosphere for increasing shelf life and maintaining food quality.

Food Packaging

“Food packaging’’ means package to be used for the containment, protection, handling, delivery and storage, transport and presentation of food, from raw materials to processed food, from the producer to the user or consumer, including processor, assembler or other intermediary.

Non Intentionally Added Substances (NIAS)

“Non intentionally added substances (NIAS)’’ means chemicals that are present in a food contact material or food contact article but have not been added for a technical reason during the production process.

Aseptic Packaging

“Aseptic packaging’’ means process where a sterilized product is filled into a sterilized container and sealed in a sterile environment to prevent contamination.

Public Consultation Process

FSSAI invited comments from stakeholders on the draft amendment. Food businesses, packaging manufacturers and industry associations may submit suggestions or objections.

The consultation period remains open for sixty days. Afterward, the authority will review stakeholder feedback and finalize the amendment if required.

Impact on Food Businesses and Packaging Manufacturers

The amendment mainly introduces regulatory definitions. However, these definitions will influence future interpretation of packaging regulations.

Clear terminology allows regulators to apply packaging requirements consistently. In addition, it helps food businesses choose suitable packaging materials.

Manufacturers of food contact materials must ensure compliance with prescribed safety standards. Similarly, businesses using modified atmosphere packaging or aseptic packaging should review their processes carefully.

Furthermore, companies should evaluate the presence of non intentionally added substances in packaging materials to ensure consumer safety.

Conclusion

The FSSAI Packaging Amendment Regulations 2026 strengthen the regulatory framework for food packaging in India. The draft amendment introduces definitions for food contact materials, food grade contact materials, modified atmosphere packaging, NIAS and aseptic packaging.

Consequently, these definitions improve regulatory clarity and support safer food packaging practices. Stakeholders should therefore review the draft amendment carefully and stay informed about future regulatory developments.
