FSSAI Pan masala ban on Food label

Extension of Compliance Timeline for Pan Masala Warning Statement

On 7 December 2023, the Food Safety and Standards Authority of India (FSSAI) issued a notification extending the time period for compliance with the mandatory warning statement requirements for “Pan Masala” under the Food Safety and Standards (Labelling and Display) Second Amendment Regulations, 2022.

Background of the Regulation

  • The requirement is specified under Schedule II of the FSS (Labelling and Display) Regulations.
  • The regulation mandates that the warning statement for “Pan Masala” must cover 50% of the front of the pack.
  • The objective is to ensure clear and prominent health warnings for consumers.

Extension of Compliance Timeline

  • FSSAI granted an extension of six months for implementation.
  • The extension is effective from 1 November 2023.
  • This means Food Business Operators (FBOs) dealing with Pan Masala were provided additional time to align their packaging and labeling with the prescribed requirements.

Implications for Food Business Operators (FBOs)

  • Manufacturers and marketers of Pan Masala must update packaging artwork to ensure the warning statement occupies 50% of the principal display panel (front of pack).
  • Non-compliance after the extended timeline may attract regulatory action under the Food Safety and Standards Act, 2006.
  • Businesses are advised to review packaging inventories, printing schedules, and distribution channels to ensure smooth transition within the extended compliance period.

FBOs involved in the manufacture, packaging, and sale of Pan Masala should closely monitor official FSSAI notifications and ensure full compliance with labeling and display requirements to avoid penalties and enforcement action.
